bACTIVE Terms Conditions

1.1       bACTIVE is ANGUSalive’s sport and leisure membership scheme.

1.2       Once a bACTIVE membership agreement has been entered into online or by a signed application form, you will be deemed to have accepted the terms and conditions of the scheme and as such will be bound by these until the agreement is terminated in accordance with these conditions.

1.3       For the purpose of the membership scheme the term ‘individual’ means any person.

1.4       Memberships are not transferable and any use other than by the named person will result in cancellation with no refund available.

1.5       ANGUSalive reserves the right to refuse access to the membership scheme.

1.6       ANGUSalive reserves the right to refuse or suspend the use of any membership.

1.7       You must keep your personal details up-to-date.  You can make changes through your online account or email membership@angusalive.scot.

1.8       If you wish to make changes to your membership (add/remove members) please contact your local sports centre.

1.9       Memberships may be subject to an annual price increase on or around the 01 April.  You will be given at least 10 days’ notice of any proposed change.

1.10     Periodic reviews of membership packages will be carried out.  ANGUSalive will inform members of any changes with a minimum of 30 days’ notice by the following means of contact: social media, email, website and public notices.

1.11     You must comply with the Sports Activities Booking Terms & Conditions.

1.12      You must comply with the Learn to Swim Terms & Conditions.

1.13     Facilities may at times have to close or make changes to the timetable.  However, across the county there will be other facilities available.  There will be no alterations to the membership fees on these occasions.  We assure our customers that we always make every effort to maintain our facilities to the highest standards.

1.14     All users are bound by the Management Rules. ANGUSalive reserves the right to refuse admission or ask you to leave any ANGUSalive sport facility if we reasonably believe that you are in breach of any section of the Rules.

2.1       bACTIVE memberships can be paid annually or monthly by direct debit

2.2       For annual memberships, whether paid up front or by monthly direct debit, you are committing to a minimum one-year contract from the date the membership is taken out.

2.3       At the time of joining the bACTIVE direct debit scheme, an initial pro-rata payment will be required to cover the period up to the 1st of the month.

2.4       The bACTIVE membership is valid if the member continues to pay the monthly or annual fee.

2.5       bACTIVE LITE is our pay as you go option where you pay per activity in accordance with the sports charges.

2.6       All bACTIVE memberships are legally binding contracts between the user and ANGUSalive and represents a commitment to pay all monthly or annual payments until the contract is completed or terminated.

2.7       All direct debit returns are added as an outstanding payment except for Refer to Payer.  These will be requested for a second time within the month and if not collected on the second attempt will then be added as an outstanding payment.

2.8       Any member who falls behind in payments for more than one calendar month will forfeit their membership.  Subsequent reinstatement of the membership or any future membership will be subject to the outstanding membership being  paid in full plus a pro-rata payment to cover the period up to the 1st of the month.

2.9       bACTIVE membership fees are non-refundable.

2.10     To qualify for a joint bACTIVE membership, the two adults do not have to stay at the same address.

2.11     To qualify for a Junior bACTIVE membership the child must be 17 or under or still in secondary education.  Proof may be required.

2.12      To qualify for a Young Persons bACTIVE membership the person must be 18 to 25 years of age. This is an individual membership and proof of age is required (passport, driving licence, Young Scot card or birth certificate).

2.13      There are flexible family membership options available with up to a maximum of two adults and any number juniors (proof may be required).

2.14      Anyone 17 or under must stay at the same address as the main member.

2.15      For juniors under the age of 16, the parent/guardian will arrange the membership and Direct Debit on their behalf.

2.16     There is the option to freeze membership which is normally for a minimum of three months and a maximum of six months. There is no charge to freeze your membership.  To freeze your membership, you must complete the online bACTIVE Membership Cancellation/Freeze Form at www.angusalive.scot/contact-us

2.17      Annual membership are not refundable and cannot be frozen, downgraded or changed.  Refund will only be issued under medical circumstances at the chief executive’s discretion.  Pregnancy is not included as a medical condition.

2.18      ANGUSalive reserve the right to review monthly Direct Debit fees. If the amounts change ANGUSalive will notify you 10 working days in advance of your account being debited.

3.1       Online joiners are entitled to a 14-day cooling off period if the facilities have not been used.  To cancel your agreement, you must complete the online bACTIVE Membership Cancellation/Freeze Form at www.angusalive.scot/contact-us. Members joining in person at a sports centre are not entitled to the 14 days cooling off period.

3.2       If ANGUSalive wish to cancel the bACTIVE membership – a minimum of one month’s notice will be issued in writing by ANGUSalive.

3.3       If you wish to cancel your bACTIVE Membership you must give a minimum of one full calendar month’s notice by completing the online bACTIVE Membership Cancellation/Freeze Form at www.angusalive.scot/contact-us.

3.4       Cancelling your Direct Debit instruction at the bank without notifying ANGUSalive is not the same as cancelling your membership and as a result you will still be obligated to pay the fees.

3.5       Your notice shall commence from the 1st of the month following the receipt of your cancellation notice. Cancellations received after this date will require one further payment with usage extended to the end of the next month. Any fees that are due up to the date of cancellation must be paid.

3.6       In order to cancel your bACTIVE membership, you must have held your membership for a minimum of one month.

3.7       For annual memberships, whether paid up front or by monthly direct debit, commitment is for a minimum of year from the date the membership is taken out and you will be liable for the full payment

3.8       When join as part of a membership promotion, you must hold the membership for a minimum of three months and must give one month’s notice to cancel.

4.1       This is an individual membership and is available to the following:

a. Full-time student**

b. Anyone on a work-based training programme (apprenticeship)**

c. Anyone in receipt of:

    • Income related job seekers allowance*
    • Income related employment support allowance*
    • Income support*
    • Universal credit*
    • Working tax credit**
    • Housing benefit**
    • Pension credit (guaranteed credit only)**

4.2       To be eligible you must have a letter/email from the awarding agency in the name of the membership applicant and dated within last 6 or 12 months depending on the entitlement.

4.3       Concessionary memberships will be reviewed every 6 months for those marked with * and 12 months for those marked with **.  ANGUSalive will contact you to request proof of ongoing entitlement.

5.1       The Angus Concessionary Entitlement Scheme is an individual Pay as You Go membership where a 12 month fee is payable and entitles you to the concessionary charges. Entitlement and proofs are as listed in section 4.1. In addition, adults 60+ are entitled with proof (eg National Entitlement Card (bus pass), photo driving licence or passport).

5.2       Customers who are registered as Angus Carers will be entitled to concessionary rates.

5.3       Customers who are registered as Young Carers will be entitled to the relevant bACTIVE membership category for an individual free of charge. Proof of entitlement is required.

5.4       Customers who require assistance when using facilities may apply for the Buddy Scheme. This scheme allows service users support when attending or taking part in physical activity sessions by allowing the customer to have a buddy attend a session with them free of charge. 5.5        Angus athletes who are in national squads at Scottish, United Kingdom or Great British levels can enrol on the NASA (National Athlete Support – Angus) Scheme. This entitles them to free use of sport & leisure facilities relevant to their training programme as agreed with an ANGUSalive community sports hub co-ordinator. 5.6      Corporate membership with approved partners, staff ID badge is required as proof for eligibility. This will be reviewed quarterly with employers to confirm ongoing entitlement.

5.7        bACTIVE members are entitled to access to the Leisure Link Partnership Scheme. This is for occasional use.

5.8        bACTIVE members are entitled to the ‘Extra Value’ benefits as listed on the ANGUSalive website. This does not apply to junior members.

6.1       This membership allows children to attend a swimming lesson and public swimming sessions.

6.2       The membership can be cancelled at any time, if cancelling after the 20th of the month, you are liable to pay the following month, and can attend lessons at this time. If cancelled before the 20th of the month, the membership will be cancelled on the last day of the month, with no further payments due. Your child will be removed from lessons on the last day of their membership.

6.3       The Learn To Swim Membership cannot be frozen.

6.4       If there are any outstanding payments on the membership, your child will not be able to attend lessons until the payment issue is resolved.

6.5       If your child is on a Junior Membership or a Add on Membership to an Adult then the terms and conditions of these membership types apply.

7.1       This membership allows members to attend Elevate classes.

7.2       The membership can be cancelled at any time. If cancelling after the 20th of the month, you are liable to pay the following month, and can attend classes at this time. If cancelled before the 20th of the month, the membership will be cancelled on the last day of the month, with no further payments due. Your Bolt on will be removed from your membership. 7.3       The Elevate stand-alone cannot be frozen.

7.4       If there are any outstanding payments on the membership, you will not be able to attend classes until the payment issue is resolved.

8.1       bACTIVE membership cards are physical or digital cards that serve as proof of membership.

8.2       Proof of membership must be presented to obtain any agreed benefit that may be offered from time to time as part of a promotion authorised by ANGUSalive.

8.3       Proof of membership must be used to gain entry every time a visit is made.

8.4       Digital cards are available on the ANGUSalive App.

8.5       Although physical cards are no longer issued some members will still have physical cards. These remain the property of ANGUSalive and lost or stolen cards should be reported as soon as possible to the reception desk at any ANGUSalive sport facility.

9.1       The referral offer is available for the following adult (18 years and over) monthly Direct Debit bACTIVE memberships:

  • Monthly
  • Flex-Monthly
  • Off Peak
  • Concessionary

9.2       Add-ons, Family, Young Persons and Junior memberships are not included.

9.3       The referrer must be an existing adult main member.

9.4       The referrer will only receive the discount if the friend joins one of the bACTIVE memberships listed in para 8.1.

9.5       A £2 discount will be applied to the referrer’s (see para 8.3 above) monthly Direct Debit for each friend that joins (see para 8.4) up to a maximum of 5.

9.6       The discount will be applied to the next Direct Debit once the referred friend has joined.

9.7       The referrer will continue to receive the discount up to a maximum period of 12 months and as long as the friend continues to be a paying member. If the friend cancels their membership or defaults on payments the discount will be withdrawn

9.8       Referrals can only be made through the ANGUSalive App.

9.9       All bACTIVE terms and conditions apply.
